SnagEasy - Terms of Service

1. Introduction
1.1 Scope of Terms: 1.1.1 These terms and conditions govern the provision of services by Snag Easy, hereinafter referred to as "the Company."
1.2 Understanding the Terms: 1.2.1 Please carefully review these terms before submitting your order. They outline our services, contractual obligations, potential changes, dispute resolution, and other crucial information.

2. Contract Formation
2.1 Order Acceptance:
2.1.1 Our acceptance of your order occurs when we send an email notification confirming the contract. An invoice for the remaining service cost will follow.
2.2 Communication: 2.2.1 We may contact you via telephone, email, or written correspondence using the details provided during the order process.
3. Service Provision
3.1 Inspection Date:
3.1.1 The snagging inspection will be conducted on the agreed-upon date.
3.1.2 Requests to change the inspection date within 2 days of the original date may incur an additional deposit of £45.
3.2 Extent of Services: 3.2.1 The inspection will adhere to RPSA New Build Survey Inspection & Reporting Standards v1.4 Nov 2021.
3.2.2 Optional extras, such as thermal image analysis and/or drone inspection, will be provided if requested and deemed feasible.
3.3 Limitations of Services:
3.3.1 Our reports do not cover the structural condition of the property.
3.3.2 Defects considered part of the natural drying out or settlement process for new builds are excluded.
3.3.3 We are not Gas Safe or Part P registered; advice from qualified professionals is recommended for gas and electrical installations.
3.4 Access and Safety:
3.4.1 Delays or inability to access the property due to factors outside our control may result in additional fees.
4. Right to Cancel
4.1 Cancellation Rights:
4.1.1 Consumers can cancel within 14 days of contract confirmation, subject to limitations.
4.1.2 If services are requested within this period, cancellation rights may be affected.
4.2 Cancellation Procedure:
4.2.1 To cancel, inform us via email or post using the contact details provided.
4.2.2 Reimbursement details are outlined based on the timing and nature of the cancellation.
5. Our Rights to End the Contract
5.1 Contract Termination:
5.1.1 The Company reserves the right to end the contract for various reasons, including non-payment, lack of access, or material breach of terms.
5.2 Compensation:
5.2.1 Compensation may be deducted from any advance payments for net costs incurred due to contract termination.
6. Consumer Rights and Responsibilities
6.1 Reporting Issues:
6.1.1 Clients must report questions or complaints about services within five working days of receiving the report.
6.2 Legal Rights Summary:
6.2.1 Clients have legal rights regarding service conformity, reasonable care, and timely completion.
7. Price and Payment
7.1 Pricing:
7.1.1 Service prices (including VAT) are indicated on order pages.
7.1.2 Additional charges may apply for car parking or congestion.
7.2 Payment Terms:
7.2.1 Full payment must be made in advance at least 48 hours before the agreed inspection date.
7.2.2 Deposit payment is by credit or debit card; balance payment is via bank transfer or cash payment.
8. Liability for Loss or Damage
8.1 Responsibility for Damage:
8.1.1 We are liable for foreseeable loss or damage caused by negligence during service provision.
8.1.2 Clients are responsible for pre-existing faults or damage.
8.2 Business Losses:
8.2.1 We are not liable for business losses incurred by commercial clients.
9. Data Protection and Privacy
9.1 Use of Personal Information:
9.1.1 Personal information is handled in accordance with our privacy policy.
10. Miscellaneous Provisions
10.1 Contract Transfer:
10.1.1 The Company may transfer rights and obligations to another organization, with prior notification.
10.2 Image Use Consent:
10.2.1 Clients consent to the Company using images from the report for training, promotional, and marketing purposes.
10.3 Report Changes:
10.3.1 No changes will be made to the report content once published, except to correct inaccuracies provided at booking.
10.4 Contractual Amendments:
10.4.1 Any changes to the terms require written agreement.
10.5 Governing Law:
10.5.1 These terms are governed by English law, and legal proceedings may be brought in English courts.
